Why is a Will important?
Your Will is a record of what you would like to happen to your assets after your death. Without a Will, there is a chance that they could pass to someone you would not have chosen to receive them. There is also a risk that a dispute could arise between your family members if they have different opinions as to what your wishes would have been.
Making a Will is your opportunity to take care of your loved ones and ensure that your estate is shared in the way that you want. You can choose who you would like to deal with the administration and who you would like to be a guardian for your children if they are under 18. Without a Will, the court would have to make this decision.
You can also choose how to structure your estate, for example, at what age you would like your children to inherit and whether you wish to leave any of your assets in trust.

Why is a Lasting Power of Attorney important?
A Lasting Power of Attorney is a legal document appointing a trusted relative or close friend to deal with your affairs on your behalf, should you ever be unable to manage them yourself. You can make two types of LPA – an LPA in respect of your property and financial affairs and an LPA in respect of your health and welfare.
You are strongly recommended to put an LPA in place at the same time that you make your Will. An LPA does not need to be used straight away but can be stored until required.
Without an LPA, your family could face difficulties if you ever become unable to manage your own affairs as they would not be able to pay bills or make decisions on your behalf. They would need to make a lengthy and complex application to the Court of Protection. An LPA will give them the legal authority to step in to help you.
